Symphony Application Terms and Conditions of Use

Preamble

Welcome to Bourbon Digital!

These Terms of Use (hereinafter “TOU”) govern the access and use of our Symphony web application. Symphony is designed to be our central operational hub and the main point of entry for interaction with our hybrid Human-IA Artificial Intelligence (AI) ecosystem. Our vision is to make Symphony the nerve center of our operations, ensuring efficient human-in-the-loop (HITL) control and seamless management of our services, including our AI-enhanced Google Workspace offerings.

Our aim is to offer you “Digital Serenity” through optimized, transparent and secure management of your services, while placing people at the heart of operations, in line with our philosophy and current regulations such as the RGPD and the AI Act. Symphony is the interface that gives humans the means to understand, criticize and decide, based on AI.

These GCU are addressed to our Customers (European VSE/SME) and to our Reseller partners (hereinafter referred to collectively or individually as “you” or “the User”).

The use of Symphony implies the full acceptance of the present Terms and Conditions.

Definitions

  • Symphony : The web application serving as an operational hub and access portal to Bourbon Digital's services and support.
  • Bourbon Digital : The Digital Services Company (ESN) which publishes Symphony and provides associated services.
  • User : Any legal entity (Customer or Reseller) or natural person (employee of a Customer or Reseller) authorized to access and use Symphony.
  • Customer: Any European SME using Bourbon Digital services, including Google Workspace.
  • Reseller : Any Bourbon Digital partner managing its own customers via Symphony.
  • Services : All services provided by Bourbon Digital that are accessible or managed via Symphony (Google Workspace management, support, training, etc.).
  • Hybrid Agentic AI : Our ecosystem combining specialized AI agents and Bourbon Digital's human team.
  • HITL (Human-in-the-Loop): Symphony's integrated Human Control process, enabling human supervision, validation or intervention in AI-managed processes.
  • RGPD : The General Data Protection Regulation (EU 2016/679).
  • AI Act : European Union regulations on artificial intelligence.

Purpose of the GCU

The purpose of these Terms and Conditions is to define the terms and conditions under which Users are authorized to access and use the Symphony application and related services.

Acceptance and Modification of the T&Cs

Access to and use of Symphony is subject to unconditional acceptance of these Terms and Conditions. You acknowledge that you have read, understood and accepted these conditions at the time of your first connection or use.

Bourbon Digital reserves the right to modify these TOU at any time. Any modification will be brought to your attention by any appropriate means (notification in Symphony, email, etc.) and will come into force as soon as it is published. It is your responsibility to regularly consult the GTU. Continued use of Symphony after modification constitutes acceptance of the new GTC.

Symphony access

  • Account Creation : Access to Symphony requires the creation of a user account. You agree to provide accurate, complete and up-to-date information when registering and to keep it that way.
  • Identifiers : Your identifiers (username and password) are strictly personal and confidential. You are solely responsible for their storage and use.
  • Safety :
    • You must respect the defined password policy (length, complexity, renewal). Passwords will expire every 90 days, and the history of the last 5 passwords will be kept to prevent their re-use.
    • Multi-Factor Authentication (MFA) may be required to enhance the security of your account.
    • You must notify Bourbon Digital immediately of any unauthorized use of your account or any other breach of security.
  • Suspension of Access: Bourbon Digital reserves the right to suspend access to Symphony in the event of non-compliance with these Terms and Conditions, fraudulent use or risk to the security of the system.

Services accessible via Symphony

Symphony is your main point of entry for interacting with Bourbon Digital. Depending on your role (Customer or Reseller), you will be able to :

  • For customers :
    • Access your services, including Google Workspace.
    • Submit technical support requests.
    • Access training resources and interact with our trainers.
    • View your orders, contracts and quotes.
    • View a dashboard on the use of your services.
  • For Resellers :
    • Manage your own customers' users (add, import, update, delete) for the domains you administer.

These functions are subject to change.

Obligations of the User

By using Symphony, you agree to :

  • Use the application in accordance with these GCU, the laws and regulations in force (in particular the RGPD ).
  • Do not compromise the security, integrity or operation of Symphony.
  • Ensure the security of your login and access.
  • Provide accurate and up-to-date information.
  • Respect the intellectual property rights of Bourbon Digital and third parties.
  • If you are a Reseller, make sure you have the necessary authorizations from your customers to manage their users via Symphony and respect the RGPD in these operations.
  • Not to use the services for illegal, fraudulent or malicious purposes.

Bourbon Digital's obligations

Bourbon Digital commits to :

  • Implement the necessary resources to ensure the availability and smooth running of Symphony.
  • Ensure the security and confidentiality of your data in accordance with our Privacy Policy and the RGPD.
  • Implement Zero Trust and Least Privilege security principles to protect data access.
  • Provide you with technical support via Symphony channels.
  • Inform you of any important changes to Symphony or to the present GTC.
  • Comply with the requirements of the AI Act, particularly in terms of human supervision (HITL) and data governance.

Intellectual Property

The Symphony application, its structure, its content (texts, images, logos, etc., with the exception of your own data) and the specific source code developed by Bourbon Digital are the exclusive property of Bourbon Digital and are protected by intellectual property laws.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of Symphony, whatever the means or process used, is forbidden, except with the prior written authorization of Bourbon Digital.

You remain the owner of the data that you entrust to us or that you generate through the use of the Services. You grant us the necessary rights to process this data in order to provide you with the Services.

Privacy Policy

Bourbon Digital is committed to protecting your personal data in accordance with the GDPR and our Privacy Policy, accessible at Privacy Policy. We invite you to consult it to understand how we collect, use and protect your data.

Liability

Bourbon Digital undertakes to provide Symphony and the associated services with diligence and according to the rules of the trade. We are subject to an obligation of means.
We cannot be held liable in the following cases:

  • Improper use of Symphony by the User.
  • Unavailability or malfunction of Symphony resulting from external causes (force majeure, network failures, etc.).
  • Loss of data or damage resulting from a fault or negligence on the part of the User (particularly in the management of his/her identifiers).
  • Consequential damages.

Suspension and Termination

In the event of a serious or repeated breach by the User of these GTC, Bourbon Digital reserves the right to suspend or terminate the User's access to Symphony, without notice or compensation, and without prejudice to any damages that Bourbon Digital may claim.

The User may terminate his or her access to Symphony in accordance with the terms of his or her service contract with Bourbon Digital.

Applicable law and jurisdiction

These GCU are governed by French law.

In the event of a dispute relating to the interpretation, performance or validity of these GCU, and failing amicable resolution, the competent courts will be those of Saint-Denis de La Réunion, notwithstanding plurality of defendants or third-party claims.
